LEGISLATIVE ACTION COMMITTEE ("LAC")

Delegates present: Barbara Kanz, Denise Bower, Karna Gustafson,
Cheryl Brendle, David Schwindt, Jack Herring, Rich Vial
A. Treasurer's Report. David Schwindt reported
we have $3,966.00 in the bank.
B. Discussion on Possible Repeal of CPA Review
Requirement. There is a rumor that certain legislators are not
in favor of this review requirement in the statute. The delegates
determined to wait for a legislator to propose modification to
the Acts and then respond. Discussion followed relative to maybe
raising the dollar amount for the budget and adding a minimum
number of units before a review would be required.
C. Discussion on Legislator Reception. Discussion
tabled to next meeting.
D. Lien Priority. We discussed hiring a lobbyist.
We discussed the HUD study as the basis for a proposed rule for
requiring an escrow for fees. The study indicated the super priority
and modified priority states. Delegates discussed proposing the
super priority lien versus a Washington State style 6-month priority
lien. A motion was made to drop the super priority Bill and have
the Washington State style 6-month priority Bill as a backup.
Vote: One abstain and remainder voted in favor. The Bill will
be forwarded to CAI National for approval prior to it being "dropped"
with the legislature.
E. Banking Statute Not a CAI Matter. The Working
Group is handling on that.
F. OWCAM Liaison. No report.
G. Working Group Liaison. Discussion of timing
to "drop" Working Group's Bill. The LAC delegates want
to review the draft Bill.
H. CAI Liaison. Denise Bower brought to the delegate's
attention that CAI has a meeting scheduled on March 16, 2005 regarding
the LAC program. We were not informed of that. David Schwindt
will follow up with CAI board members.
Next meeting is scheduled for February 15, 2005
at Noon at CMI.
