COMMUNITY ASSOCIATION INSTITUTE
LEGISLATIVE ACTION COMMITTEE ("LAC")

Delegates present: Rich Thompson, Denise Bower, Karna Gustafson, Barbara Kanz,
Rich Vial, Cheryl Brendle, Jack Herring

A. Minutes. There was a motion and second to approve the Minutes from the May and June LAC meetings. The motion passed.

B. Treasurer's Report. None. David Schwindt was not present.

C. Double Taxation. We had discussion on the content of the survey to be distributed to members and non-members. There was also discussion on the type of response we would need in order to determine whether the LAC should proceed on this issue. Rich Thompson will revise and e-mail the survey to his distribution list and provide a link to the CAI information on this issue. Rich Vial will post the survey to his website.

D. Lien Priority. On August 4th Rich Vial and Barbara Kanz will meet with a Fannie Mae Director, Dick Anderson, who is also the President of Mortgage Bankers' Association, Jack Zuber and Jim Marque, the Oregon Mortgage Bankers' lobbyist. They will be promoting the concept that all assessments have priority over all liens except taxes and municipal liens.

E. Resale Disclosure. We discussed whether the LAC was in favor of a resale certificate. Rich Vial reported that both Maryland and Virginia have a requirement that the Board fill out the certificate in good faith. We reviewed the state of Washington's resale certificate for concept. Further discussion to occur next meeting on whether we proceed. There seemed to be no opposition from the delegates on the resale certificate. There was only discussion on what the content of the resale certificate should be.

F. Maintenance Turnover Book/Cost. No report. George Carter was not present.

G. OWCAM/Condominium Working Group Update. Update was given by Barbara Kanz.

H. New Business. Denise Bower reported that the CAI chapter wanted us to discuss whether or not we would endorse a proposal to allow management offices in residential zones. Rich Vial will talk to Stuart Cohen to find out more information.

Next meeting is August 24, 2004 at CMI at Noon.
