LEGISLATIVE ACTION COMMITTEE ("LAC")

Delegates present: Rich Thompson, Denise Bower, Karna Gustafson, Rich Vial,
Cheryl Brendle, and David Schwindt

A. Approval of Minutes. Minutes were approved for July 27, 2004.

B. Treasurer's Report. David Schwindt reported that we have $3,842.50 in our checking account. Denise Bower is going to contact National to request a dues increase for the LAC.

C. Double Taxation. Rich Thompson put an article in his Regenesis newsletter regarding the issue. He will be sending out the survey to his membership base soon.

D. Lien Priority. Rich Vial has had two meetings with other trade groups, including OMBA. He has made the argument that HOAs should have liens similar to municipal liens for taxes. The next step will be for Rich Vial to send a letter to various trade organizations regarding CAI's position on lien priority. Rich Vial reported that he already has two sponsors in the Legislature, including Joe Smith who is a democrat, and a republican who he could not recall the name. The Bill will be dropped in November for pre-session. Barbara Kanz is drafting the legislation. The LAC delegates expressed an interest in reviewing the legislation before it is introduced.

E. Resale Disclosure. Rich Thompson reported that the Oregon Real Estate Agency is against this type of legislation, at least this session. Currently, OWCAM is working on an educational approach to this issue. It was also reported that OAR may be hostile toward the resale disclosure. We will keep it as an agenda item, but do not plan to do anything this legislative session.

F. Maintenance Turnover Book/Cost. No report. George Carter was not present. It was reported that OWCAM may be addressing this issue.

G. OWCAM/Condominium Working Group Report. OWCAM is planning a program on the forensic mold issue. They have an expo planned for January at the Holiday Inn Airport on January 21. Barbara Kanz gave the working group an update on the legislation they are currently working on.


H. New Business. Dominic Colletta asked if we were interested in pursuing a legislative requirement to establish reserve accounts. Discussion followed.

Next meeting is October 19, 2004 at CMI at Noon.
