LEGISLATIVE ACTION COMMITTEE ("LAC")

Delegates present: Barbara Kanz, Rich Thompson, Denise Bower, Karna Gustafson,
Cheryl Brendle, and David Schwindt

By Invitation: Dominic Colletta

A. Denise Bower reported that George Carter resigned from the LAC. Discussion followed regarding a replacement delegate. It was proposed that we nominate Dominic Colletta as a delegate. All delegates present were in favor of that nomination. He will need to fill out an application and Denise Bower will forward it to CAI National.

B. Approval of Minutes. Minutes from September 28, 2004 were approved.

C. Double Taxation. Rich Thompson reported that he has had no reaction to the article he placed in Regenesis regarding this issue. Discussion followed whether the delegates are interested in pursuing this issue at this time. It was moved and seconded that we would not be pursuing this issue.

D. Lien Priority. Rich Vial was not present. Barbara Kanz gave a brief update. Rich still needs to follow up with OMBA. Barbara is working on getting the legislation to legislative counsel. The delegates advised Barbara they would like to review the legislation before it gets presented as a Bill.

E. Resale Disclosure. Delegates voted to remove this from the agenda. We will not be pursuing this issue at this time. It was reported that OWCAM is working on this issue.

F. Treasurer's Report. David Schwindt reported that our checking account balance is similar to the last report he gave last month.

G. OWCAM Liaison. It is reported that OWCAM is working on an insurance deductible program for October 20.

H. Working Group Liaison. No report.

I. New Business.

1. It was discussed that we should hold a luncheon or cocktail hour for some of the legislators after the election.

2. Dominic brought up the Walsh case on indemnification. Dominic is to send us a copy of the case and the statutory reference.

Next meeting is November 16, 2004.
